Every week we see horrific cases of animal abuse and what happens when offenders are convicted?
They get small fines…suspended sentences and are back on the street..
The Problem.
Based on observed and documented cases offenders frequently recieve minimal fines or suspended sentences.
Repeat offenders are not adequately prevented from reoffending..
Magistrates lack clear sentencing guidelines.
Weak penalties fail to deter repeat offenders.
Public confidence in the SPCA and it’s authority are undermined..
PROPOSED AMENDMENT.
1.Severe cruelty offences should carry mandatory custodial sentences.
2.Eliminate reliance on fines and suspended sentences for severe abuse cases.
3.Introduce structured guidelines for Magistrates to ensure consistency.
4. Distinguish between negligence,abuse and aggravated cruelty.
5.Repeat offender classification.
6.Create a national offenders registry.
7.Fast track prosecution..
Conclusion..
The current legal framework is outdated and insufficient to address modern realities.
Reform is necessary to ensure JUSTICE,DETTERENCE AND PUNISHMENT.
